혁신과 규제의 딜레마:

한국의 모빌리티 플랫폼 정책 사례를 중심으로

운송네트워크 플랫폼 기업(TNC)인 우버의 시장 진출 이후 한국 정부는 모빌리티 플랫폼 서비스를 기존의 시스템에 어떻게 받아들일 것인가, 즉 이를 신산업 영역으로 인정할 것인지, 아니면 전통적인 운수업 규제 안에 포함할 것인지를 두고 결정의 어려움을 겪었다. 이 논문은 새로운 산업의 출현이 기존산업 중심 규제체제와 충돌하면서 빚어내는 딜레마를 정부가 무시하는 상황에 주목하였다. 딜레마 모형을 프레임 개념으로 재구성하여 사례를 분석한 결과, 규제와 혁신이 서로 딜레마 상황이라는 신호가 충분히 가시적이지 않았다는 것을 알 수 있었다. 그것은 프레임을 구성하는 항목들 간의 결합이 약하고, 프레임 간의 충돌이 임계점을 넘지 못했기 때문이다. 딜레마를 무시했기 때문에 정부의 결정은 혁신 프레임이 아니라 택시운송사업자 보호라는 전통적인 규제프레임을 옹호하는 방향으로 이루어졌다. 그러나 상황이 딜레마일 경우 어느 한쪽의 입장을 반영한다고 문제가 해결되지는 않는다. 정책실패의 가능성을 줄이기 위해서는 상충적인 프레임 각각에 대한 충분한 관심과 토론의 기회를 보장하며 공론의 장을 활성화할 필요가 있다.

Betwixt Regulation and Innovation:
The Policy Dilemma of Mobility Platform Services in Korea

Since Uber’s first entry into the market, the Korean government has faced difficulties on whether to incorporate transportation networks (TNCs) policy into the existing taxi regulation system, or within the ICT industry policy. Almost all taxi drivers insisted on the former, whereas IT businesses and customers insisted on the latter. Taxi drivers advocated for valuing the right to survive, whereas the IT forerunners advocated for valuing the future new growth engine. This study focuses on this policy dilemma of emerging new industry in conflict with existing industry- oriented regulatory regimes, and the government’s response to the dilemma. For the analysis, we reconstruct existing dilemma model based on the frame concept by adding frame combinations and frame conflicts as conceptual devices. In the case of mobility platform policy, the Korean government ignored the dilemma because the signal was too weak to be detected properly. This resulted from the loose frame coupling and the weak collision between the two frames. If a policy dilemma continues to be ignored, there will be a vicious cycle of continuous policy failures. To prevent a neglected dilemma from occurring again, public discussion will help ensure sufficient attention and discussion opportunities for each frame.
