금융회사 내부통제 정책변동 분석: 정책피드백이론과 다중흐름모형을 중심으로

본 연구는 「금융회사의 지배구조에 관한 법률」의 개정 사례를 대상으로 정책피드백이론과 킹던(Kingdon)의 다중흐름모형(MSF)을 결합하여 금융회사 내부통제 정책의 변동 과정을 분석하였다. 분석 결과, 2016년 법 제정이 발생시킨 해석효과와 자원효과는 문제·정책·정치의 세 흐름 전반에서 작동하였으며, 흐름에 따라 상대적으로 우세한 효과가 다르게 나타났다. 해석효과는 정책변동의 방향에, 자원효과는 이러한 변동이 실행 가능한 대안으로 전환되는 시점에 영향을 끼쳤다. 반복된 금융사고는 내부통제 실패를 개인의 일탈이 아닌 조직적·제도적 책임의 문제로 재해석하게 하였고(해석효과), 기존 법률이 부여한 감독 권한과 정보자원을 통해 책무구조도를 중심으로 한 대안이 구체화되었다(자원효과). 특히 본 연구는 기존 제도에 대한 부정적 피드백이 정책의 후퇴가 아니라 강화로 전환된 조건에 주목하였다. 정책 실패의 원인이 규제의 과잉이 아닌 미비로 해석되었고, 규제 완화를 요구하는 정치적 연합이 형성되지 않았으며, 대안 설계의 자원이 감독당국에 집중되어 있었다는 점이 정책의 강화를 초래한 것으로 볼 수 있다.

Policy Change in Financial Institutions’ Internal Control: 
An Analysis Based on Policy Feedback Theory and the Multiple Streams Framework

This study analyzes how internal control regulation in financial institutions changed, integrating policy feedback theory with Kingdon’s multiple streams framework and focusing on the amendment of Korea’s Act on Corporate Governance of Financial Companies. The analysis shows that the interpretive and resource effects generated by the 2016 enactment operated across the problem, policy, and political streams, although their relative influence differed from one stream to another. The interpretive effect shaped the direction of policy change, whereas the resource effect determined when demands for change could be translated into feasible alternatives. Repeated financial scandals reframed internal control failures, shifting them from individual misconduct to problems of organizational and institutional responsibility (interpretive effect), while the supervisory authority and informational resources established under the existing law enabled alternatives centered on the Responsibilities Map to be developed (resource effect). Negative feedback led to regulatory strengthening rather than retrenchment for three reasons: policy failure was understood as the result of insufficient rather than excessive regulation, no political coalition emerged to advocate deregulation, and the resources for designing alternatives were concentrated within the financial authorities.
